Conservation easements are the most traditional tool for conserving private land. A “conservation easement” (also known as a conservation restriction or conservation agreement) is a legal agreement between a landowner and a land trust or government agency that "permanently limits uses" of the land in order to protect its conservation values. It allows landowners to continue to own and use their land, and they can also sell it or pass it on to heirs.
Here are some additional methods to consider:
Donation with a Lifetime Income
If you have land you would like to protect by donating it to a land trust, but you need to receive income during your lifetime, consider a charitable gift annuity or a charitable remainder unitrust. Charitable gift annuities and charitable remainder unitrusts are most useful for highly appreciated land, the sale of which would incur high capital gains tax.

Sweet Water Trust believes that the best way to accomplish its mission of protecting land in its natural state as Forever Wild is through the use of perpetual conservation easements. These legal documents, once recorded in the appropriate registry of deeds, impose restrictions on landowners – whether individuals, land trusts, government agencies, or other forms of ownership – that are permanent and withstand changes in those ownerships. Conservation easements are “held” by land trusts or government agencies that are charged with “monitoring” the easements on a regular basis and making sure, through consultation or, if necessary, legal action, that the terms of the conservation easement are met. Thus conservation easements assure that the original intention of the land protection project will be carried out in the future.

Even land trusts, state agencies, and other conservation entities can change their missions over time – or the original intent in protecting a tract of land can be lost over the years as staff changes and institutional memory fades. This is why Sweet Water Trust, in making grants to land conservation organizations, requires a “double layer of protection” with the land first acquired by a conservation entity and then further protected, in perpetuity, by a conservation easement held by a third party – the grantee or “Holder” of the easement – which has both the right and the obligation to enforce the forever wild restrictions in the conservation easement. Stewardship endowments should be set up to ensure that that Holder has the wherewithal to meet its monitoring and enforcement obligations.

NOW, THEREFORE, in consideration of the above and the mutual covenants, terms, conditions and restrictions contained herein, and pursuant to the laws of the State of Arcadia [cite state enabling act], Grantor hereby grants to Holder a Conservation Easement in perpetuity over the Protected Property of the nature and character and to the extent hereinafter set forth (the “Conservation Easement”).

WHEREAS, [describe how the land in question fits in with other adjoining conservation land or land in the vicinity and how the overall block, corridor, or linkages help achieve the goals of wilderness protection,

WHEREAS, [Forever Wild language] it is the intention of the parties to safeguard the Protected Property as forever wild, as free as practicable from human influence, manipulation, encroachment, and development. Such human uses have reduced or eliminated the size and quality of natural areas, altered the integrity of natural communities and ecosystems, reduced ecological connectivity across the landscape, reduced ecological resilience in the face of climate change, degraded air and water quality, and initiated a global species extinction crisis.
